Summary: Internet trolls have become a problem in social media. This study seeks to determine the constitutionality of the proposed law regulating online trolling in order to ensure and maintain a safe and respectful platform for online users in the country. This study utilized the appreciative inquiry research method. Document and content analyses were used to gather data. Based on the laws enforced in other countries, online trolling may be defined as an act where a person intentionally posts a digital or electronic communication in a manner that is menacing, harassing or offensive which causes serious harm to a victim. Applying the Void- for- Vagueness and over Breadth Doctrines, this study finds that the proposed legal definition of online trolling can be easily understood by any ordinary person. The same is also not overly broad because the proposed law will only regulate trolling having the most severe impact on a victim applying the Trolling Magnitude Scale (TMS) and Harm Principle. It suggests that legislators come up with its own version of communication principles that will help determine what acts transgress the border of protected speech. It also recommends that the Department of Information and Communications Technology, Department of Justice, and National Bureau of Investigation Cybercrime Division serve in the forefront of implementing the proposed anti-trolling law and endeavor to fight online harassment through education of the general public, law enforcement personnel and empowerment of victims.
