Summary, etc Summary: House of Bill 4727 otherwise known as The Death Penalty Law is currently being deliberated upon by the House of Representatives for its passage. The said House Bill enumerated several list of crimes which according to the House of Representatives should be considered as heinous crimes under the Constitution. The people have different perceptions as to whether it is necessary to re- impose death penalty here in the Philippines. Some are in favor for its re- imposition while others are against it. With this, the study has determined the perceptions of the people as to the necessity of death penalty by conducting a multiple key informant interview in the top 5 barangays in a highly urbanized city, which is Tacloban City. Based on the interviews, death penalty is deemed as necessary because of its deterrent effect, and also as a way of retribution. It has a deterrent effect because it serves to warn the other would- be perpatrators, it reduces threat to he society, and preserves the security and safe well- being. Death penalty is also a way to retribution because it gives justice to the victims and to the latter's relatives. After determining the necessity and the grounds for its re- imposition, this study likewise determined, the proper crimes or type of crimes that should have been included in the proposed death penalty law. After which, the researcher narrowed down the definition of of heinous crimes in order to coincide it with the basis and necessity behind its reinstatement. By narrowing down the definition of heinous crimes, there are three categories that falls under it, namely: (1) Crimes with deliberate intent to kill resulting in a loss of life, (2) Crimes that deliberately Threatens life, and (3) Brutal crimes or cold blooded crimes. In conclusion, death penalty is necessary; and there are some types of crimes that should be covered in the proposed House Bill.
