Summary: The advent of the digital revolution has paved the way for the introduction of various digital platforms to acquire music, among which are the music-streaming technologies, providing a more accessible and convenient way to listen to music. However, there is also need to understand how the availability and use of these music-streaming technologies affect the intellectual property rights of local music artists, especially with regard to their economic and moral rights.<br/><br/>This study intended to examine whether or not the existing copyright laws in the Philippines are already adequate to address the different technology-related issues of copyright ownership as to better protect local music artists. This study utilized a qualitative research method. This study has been conducted in Cebu City. The informants were the recording studious or labels and/or publishing companies, as well as the Visayan music artists in Cebu City. Thematic analysis was also applied to draw the findings.<br/><br/>It was found that the use of music-streaming technologies provides more advantages- specifically accessibility for the public, broader target market reached, and transparency of data- than disadvantages to both the supplier and consumer of music. Music streaming technologies are effective platforms for the promotion and protection of the economic and moral rights of local music artists. These enable the music artist to control the reproduction of their songs. More importantly, these technologies create a digital signature which sends a notice to the public that the specific song is being owned and/or managed. However, there are still existing challenges regarding the protection of ownership, awareness of intellectual property rights, and issues regarding royalties. <br/><br/>The proliferation of music streaming technologies has enabled the copyright owners, most especially the music artist, to be in control in so far as how their songs are played and used in market. There is therefore a need to amend the copyright laws in the Philippines in order to respond to technology-related issues of copyright ownership, given the fact that the continuous advancement of modern technology is inevitable. |
