Summary, etc Summary: This thesis aims to give a balanced opinion and contribute to the issue surrounding same-sex marriage. It intends to clarify that denial of marriage to same-sex couples is not a violation of the fundamental right to marry and to equality under the law. This study hopes to provide a clearer understanding of the issue of same-sex marriage and understanding still of the homosexual people's reason for asserting that they have this right to marriage equality. This study will discuss and suggest a possible creation of a law specially intended for same-sex couples that will govern the legal effects of their union as they assert to reap the benefits given to married couples. <br/> <br/>The writer gives her views by legality and substantive reasons and not to assume that the basis of opposition is hate, bias or other such negative motivations. The literature reviews relies on actual Supreme Court cases, here and abroad, opinions from different sectors of society, religious or secular, and analysis of the writer's study of the law and personal experiences as she is shaped and influenced by her faith, thoughts, formation, and education.<br/> <br/>The most significant learning the writer had in this work is that a new dimension of reality which involves a fundamental right to freedom of choice to unite couples of the same-sex under the civil law entails acceptance. The rights, duties and benefits that go with the legal recognition of that union take precedence and put into the proper context.
