520 _aSummary: Music played a vital role in the life of every Filipino. The primary sources of these favorite songs are FM radio stations that started to hit the airwaves in the 1920's. Songs are generally created from the poetic words of writers and subsequently performed by singers. Thereby, these are protected under our intellectual property laws specifically on copyright. The Intellectual Property Code of the Philippines (RA 8293 as amended) provide that copyright owners may designate a collecting society to enforce the collection of royalty fees from those that utilize these copyrighted works. FILSCAP is collecting management organization that grants licenses for public performance and broadcast. The study intends to determine the compliance of FM stations in Cebu in the royalty payment. The research was conducted through semi-structured and structured interviews. The surveys contained questions that the stations managers of the station answered to the best of their knowledge. Results showed that all of the respondents were aware of FILSCAP and royalty fees. There was also a finding of compliance. However, it was synthesized that there are still problems in the enforcement for the issue on high rates imposed. The managers suggested from a compromise to an absolute exemption of radio for the main reason that the stations already helped the promotion of the songs and yet payments are exacted. It was also discovered that there might be awareness but a comprehensive understanding is still lacking. Thus, there must be a dialogue between the involved parties in order to devise a win-win resolution to resolve the conflict at hand. It is highly recommended to incorporate the enforcement in the KBP Broadcast Code to insure self-regulation of the member stations. there must be prorating of rates in accordance with the income of the station. And an exemption may be made upon determination of a certain threshold based on profit annually.
